General Rental Terms and Conditions (GTC)

Subject of the contract

1. Upon conclusion of the rental agreement, the renter receives the right to use the motorcycle designated in the rental agreement for the agreed period in accordance with the contract. MRC is entitled to payment of the rental fee and other agreed fees.
2. The subject matter of the contract is exclusively the rental of a motorcycle including the booked equipment/additional equipment. MRC does not owe any travel services. The renter is responsible for the trip.
3. Upon handover and return, the handover and return protocol must be completed in full and signed; both are part of the contract.

1st tenant

1. The tenant and responsible party is the signatory of the rental agreement - regardless of who has booked or paid.
2. The motorcycle may only be driven by the renter; it may not be transferred to third parties.
3. A valid A/A2 driving license is required at the time and place of pick-up, as well as compliance with all legal requirements. Driving under the influence of alcohol, drugs, impairing medication or when overtired is prohibited.
4. The renter is prohibited from pledging or selling the motorcycle or otherwise disposing of the vehicle/parts/accessories/documents insofar as this would impair MRC's rights.

2. property

MRC is the sole owner of the motorcycle named in the rental agreement. MRC employees are authorized to act on behalf of the company. Any subletting or transfer of the motorcycle by anyone other than MRC is invalid.

3. Rent

1. The object is the temporary provision of the booked motorcycle and the booked additional equipment.
2. The rental fee includes vehicle taxes, liability insurance and lubricants; fuel is not included. No mileage limit is agreed.
3. Deposit: 800 € per motorcycle in cash or by credit card (Mastercard/Visa in the name of the renter). No debit/bankomat or American Express cards.
4. The original of the valid driver's license must be presented before the vehicle is taken over.

4. Booking and payment

Down payment: 15 % of the total rental price at the time of booking. Final payment: when taking over the vehicle.

Further costs (e.g. extension) are due on return. In the event of late payment, MRC may charge a reminder fee of € 4.00 and default interest of 10 % from the second reminder. If the renter does not collect the motorcycle despite reservation or on the agreed date, MRC may demand compensation for damages; MRC reserves the right to provide evidence of lower damages.

5. handover and return

1. Handover in good overall and operating condition with all necessary documents/parts/accessories.
2. Return: in person, at the agreed place/time/condition and with a full tank. If the vehicle is returned outside business hours, the renter is liable for loss/theft/damage until the rental station opens. Rough soiling: cleaning costs to be borne by the renter. Late return: per commenced calendar day daily basic price (proof to the contrary of lesser damage possible). Return due to damage for which the renter is responsible: 2.20 €/km recovery costs.

6. withdrawal (cancellation)

6.1 Withdrawal by the tenant

• Up to 10 days before the start of the rental period: full refund of the deposit (15 %).
• From 10 days to 48 hours before the start of the rental period: the deposit (15 %) will be retained as a cancellation fee.
• Less than 48 hours before the start of the rental period: full rental price due.

6.1.2 No-show / late arrival

No-show or late arrival with recognizable services that can no longer be used: 100 % of the rental price. In the event of late arrival, the full rental price for the originally booked period remains due.

6.2 Withdrawal/termination by MRC

Termination without notice for good cause (e.g. false information, serious breach of duty); motorcycle to be returned immediately. If the motorcycle can be rented to another party, cancellation fees will be reduced accordingly.

7 Obligations of the tenant (use)

Handle with care; observe regulations/operating instructions; regularly check oil, tire pressure, chain tension. No parking on public roads at night (22:00-06:00); lock the steering lock. Prohibited: Motorsport, non-public/race-like roads, cross-border journeys from Italy, commercial use, technical/optical modifications. Report technical problems/damage to MRC immediately; no self-repairs. Compliance with the StVO; liability for fines/penalties; MRC may charge a reasonable administrative fee. The GPS tracking system installed in the vehicle must not be deactivated, shielded or manipulated during the rental period.

8 Liability of the tenant

Liability in the event of theft and for all damage to the motorcycle/documents/parts/accessories occurring during the rental period, unless fault is proven. Compensation for, among other things, repair, recovery/return costs, expert costs, technical/mercantile depreciation and loss of rental income (per day basic daily fee); in the event of theft: replacement value. Improper use (e.g. burnouts) leads to an obligation to pay compensation for excessive tire wear. We reserve the right to provide evidence to the contrary of lesser damage.

Handover in a clean, operational and roadworthy condition; previous damage only recognized if noted in writing. Necessary repairs through no fault of the renter: authorized workshop up to 150 € permitted without consultation (submit original receipts); MRC's consent above this amount. Compensation for damages against MRC excluded, unless intent/gross negligence; no limitation in the case of personal injury; in the case of simple negligence, liability limited to typical, foreseeable damage. No liability for items left behind.

10. behavior in case of accident/damage/theft

Inform MRC immediately; only engage towing/repair services after consultation. Involve the police; secure evidence; identify the parties involved. No admission of guilt; no payments/settlements that jeopardize the insurance cover.

11. Insurance Coverage

Liability insurance for third-party damage exists. No fully comprehensive insurance. Recommendation: Travel, cancellation, accident and legal protection insurance.

12th vehicle/category

Efforts to obtain the desired model; if not available: equivalent/higher-quality motorcycle at the same price.

13. Personal Information

Electronic processing of personal data for contract processing, statistics, credit checks and to protect MRC's assets; disclosure to third parties to the extent necessary in the event of breaches of contract. GPS tracking: Vehicles are equipped with GPS tracking; location/movement data is 365 days stored. Processing in accordance with applicable Italian data protection law (Regolamento (UE) 2016/679 and D.lgs. 196/2003 e s.m.i.). Details in the Data protection.

14. law

Italian law applies.

15. place of fulfillment & jurisdiction

The place of performance is the registered office of MRC. As far as permissible: exclusive place of jurisdiction is Florence, Italy.

16. Miscellaneous

Written form for ancillary agreements/amendments (including deviations from this clause). Severability clause. Authoritative language version: Italian.
